Exactly. You don't "delete" ESA protection.

All that can be done is to politely and humbly ask them for a permission to put that game up for download.

If they agree - well, you can do that. If they don't - tough luck, their right to refuse.

ESA is a fairly powerful anti-piracy organisation, and Abandonia had trouble with them over a year ago. Back then, it ended up with over 250 games being removed from the download to avoid the site being permamently closed and its crew sued out of their last pair of underwear.
Suffice to say, we don't want trouble with them ever again.
