I think it just needs to be discontinued by the producers and not being sold actively anymore.

Copyrights expire 50 years after the death of the author i think. Or until the company releases the game.

I'm not sure if it's 25 or 50 years after the death of the author(movie's per instance are 25), but I doubt that any game is yet abandonware by that way...
If oyu're in doubt you should check the oldwarez list :http://www.abandonia.com/main.php?nav=awlist If the game you're doubting isn't on the list you could check cdaccess.com(see if it's sold there), and HotU(the-underdogs.org, and see if it's available there)...

In terms of age, I think it had to be released before 1997 (besides what everyone else mentioned).
