In oldwarez list there are ESA games that are threated as abw. And we do have some ESA games which are here probably because Kosta got ESA's permission to host them.

So, what about those abw ESA games? There are some good games. Will we upload them the or not????

I don't believe that there is such a thing as abandoned ESA game.

the probleme is, tough some company are inteligent engouh to understand that this will not harm them , some are not.

Maybe some esa company have allow some of their game to be published, but I never saw any.

The other trouble is cases like "land of lore" , EA have the rights , when the game was created by westwood.
Autors rights sould ALWAY be in the hand of those who programed the game, not anyone else !

Author can sell its rights.

I believe that those companies, which are protected by ESA don't really care, as they are paying ESA to make sure their games are not distributed without their permissions.

They are not bugging us at all.

ESA is paid to do that for them.

There are some games that fall under ESA but can be considered abw as ESA won't bug about them - at least this is what Tom wrote in Oldwarez list legend.

So, are we able to put those games, or Kosta still needs to ask to be sure?

I think that this is the "initial question", the one that hasn't been answered yet, and which maybe only Kosta (or an Adm) can answer - or not, so let's wait for one of them to pronouce about it....

It's a matter of asking Kosta, like I do, before submitting games

For instance, Psygnosis is technically ESA since they were bought by Sony, but they don't seem to bug us.
