k read the description first... take a deep breath =D, lets do it all over again...now breath hard twice and say, he is just curious...k here we goo




I AM soo curious, how can a cruddy shop or just some random shop can sell this game, then declare its not abandoned..........eh? I am confused, cuz sometimes u guys give EURO sites that still sell them in their own langauges and take the game out...which makes me just ponder about..............i mean i am very cuirous, someone EXPlain the system of abandoned and Free and this and that...oh please don't flame me.....if u guys help explain to me in a nice way i buy ur smielys a round of beers, or egg nogs, emmmmmmmmmmmmm egg nog delicous

If new copies of the game are being sold through any retail channels, then--as I wrote in the last thread you said this--it's because the game isn't abandonaware. The status of the game as abandonware is determined by either its publishers or developers, not the retailers. So if you want a new copy and have to go to a website and pay for it, that's because it's still under license. Somebody besides the retailer is making money off it, and they're selling it.

If you don't like this, you can always look at sites that sell used copies, such as eBay or Amazon.

*footnote* There is nothing called Abandonware.
It's illigal, it's copyright-theft, it's against the law.

But: If there is NO way to obtain it, while credeting the developers, how then?
This is where we gather up, who actualy ENJOY playing good games with poor grafics... Well... haven't heard of any major court-cases yet on this issue..

We'r not leeching money from the developers in anyway, we'r just rebulishing theire work again, as "freeware" (as we don't charge for it). But in many cases we do this w/o theire blessing (we have some who have given theire blessing thou).

But how can it be copyright-theft, if the publishers owned the rights, ceased to exist, and never sold their intellectual property to anybody else? Granted, this isn't often the case, but I have quite a few titles out of the 1980s--such as Mindcraft's. The publisher/developer never sold the rights, but the company ceased to exist. If this isn't abandonware, then who holds the copyright in such matters?

The ppl who created the code, as persons, if theire contract didn't say otherwhise..

That's exactly why this is such a tricky matter.
