When it comes to Sierra it is a combination of both.
1. Sierra must not support it any more. 2. The abandonware community discuss the status of the game, to see if it i safe to mark it as abandoned.

2. The Abandonware community is still discussing the risks involved in declaring the game abandoned (Not done)

What are the risks?I mean if the creator doesnt support it its abandoned isnt it?

For the risks... just mail the devs of those games. If Sierra doesn't support it anymore, and you ask them 'bout the legal and non-legal risks of putting it up for download, you'll get the best advice on it
