Well as you yourself said, the copyright holder is the one who gets to decide what happens to a game. ESA is just a group that protects the copyrights of the companies that pay them. So if the company decides to release a game into public after 2 years - ESA is not going to prevent that.
The problem is that companies that bought other companies out probably don't care a lot about the older games. They simply see the good name of a game they have copyrights for as an investment. A sequal would really sell well if the original was a cult game.
