This is completely false and is an internet myth. In fact,
as soon as you download a rom you are breaking the law.
The reason behind this is that it is mentioned in the law that you can make a copy (and only one) of any media you have (like, for example, a PC game) as long as it is only as backup for your own personnal use. If you download a rom from a site then you are downloading the "backup" of someone else and thus get in violation of the law since it is very well mentioned that you can't give or sell that "backup" in any time unless it come with the original game and is part of the selling deal. You are also supposed to destroy the "backup" when you sell or dispose of the copied media.
