The publisher (Konami Digital Entertainment, Inc., formerly Konami of America) is an ESA member but the game is not protected since 5.12.2012.
Sold only on Amazon Marketplace. (Also on the German one.)

I think we can label the game as 'approved'. Can anyone confirm that?
