SouthPeak left ESA, so its not protected anymore, but what about sold-Status?

Developer (Sinister Games) is an ESA member but the game is not protected since 10.10.2010.
Still sold at Medimops.de, so I think it should remain rejected.

In that case, sold only at British and German Amazon Marketplace.
