Publisher/developer (SEGA) is an ESA member but the game is not protected since 09.09.2011.
Sold only at Amazon Marketplace (http://www.amazon.com/gp/offer-listing/B00005BJ9L/ref=dp_olp_new?ie=UTF8&condition=new) (and also at the German one (http://www.amazon.de/Avalon-Baku-Animal/dp/B00004TO9Q/ref=sr_1_2?s=videogames&ie=UTF8&qid=1339535642&sr=1-2).)

I think we can label this as 'approved'.
