Oldwarez List does not have anything on file about it.
The game "Colony Wars 2492", published by the same publisher (Black Legend) a year later has Abandonware status.

Digital X-Citement --> current name Virtual X-citement --> not known to be an ESA subsidiary, BUT Wikipedia indicates one of their games - Trains and Trucks Tycoon - has been published by Ubisoft (who are an ESA member), indicating VX-C might be an ESA subsidiary.

The game is over 10 years old, so even if the developer was ESA subsidiary the 10-year active protection period expired already.

EDIT: David beat me to it. Since it's sold, we can only wait until the store runs out of copies.
